DRIVE NOW KICKSTART AGREEMENT

This Drive Now Kickstart Agreement ("Agreement") is a separate contract between the Customer and Boise’s Best Auto Sales. It is not part of the Retail Installment Sale Contract and does not replace or modify financing terms with any lender.
- Purpose
The Customer is enrolling in the Drive Now Kickstart Program, which provides dealership services including administrative processing, account setup, documentation, and special purchase accommodations. This Agreement establishes the Customer’s obligation to pay the Kickstart Enrollment Fee and any Program Obligations owed directly to Boise’s Best Auto Sales.
When permitted by lender rules, Program Obligations may include a deferred portion of the Customer’s down payment. When lender rules require certification that all down payment funds have been collected, Program Obligations are treated as a dealer receivable and are not represented to any lender as a down payment.
This Agreement creates separate contractual obligations and does not replace or modify financing terms with any lender.
- Definitions
Program Obligation means any amount owed directly to Boise’s Best Auto Sales under the Drive Now Kickstart Program. Program Obligations are dealership obligations and are not included in the amount financed.
Deferred Down Payment means a portion of the Customer’s down payment that is permitted by lender rules to be paid after vehicle delivery and documented under this Agreement.
Dealer Receivable means a Program Obligation owed directly to Boise’s Best Auto Sales that is not represented to any lender as a down payment and does not satisfy any lender required cash due at signing.
- Gift Pack
Customer acknowledges receiving the Boise’s Best Auto Sales Gift Pack containing promotional items of value as part of participation in the Drive Now Kickstart Program.
- Kickstart Enrollment Fee

The Kickstart Enrollment Fee is a Boise’s Best Auto Sales program enrollment fee charged for participation in the Drive Now Kickstart Program. This fee is not required by any lender, is not part of the vehicle purchase price, and is separate from the Retail Installment Sale Contract. The Kickstart Enrollment Fee compensates Boise’s Best Auto Sales for administrative services, account setup, documentation, monitoring, and related program services.
The Kickstart Enrollment Fee is not included in the amount financed unless expressly approved by the lender in writing.

- Lender Rule Application
If the lender permits deferred down payments, the Program Obligation may represent a Deferred Down Payment.
If the lender requires certification that all down payment funds have been collected, the Program Obligation shall be treated as a Dealer Receivable and shall not be represented to any lender as a down payment or cash due at signing.
- Payment Terms
Payments may be made in cash, card, or approved electronic method.
A late payment more than five days past due may incur a $50.00 late fee.
A returned or declined payment may incur a $35.00 returned payment fee.
Boise’s Best Auto Sales may send reminders by text or email as a courtesy, but timely payment remains the Customer’s responsibility.
- Default
The Customer will be in default if any payment under this Agreement is not made by the due date. Boise’s Best Auto Sales may pursue any lawful collection efforts, including small claims court, assignment to a collection agency, and recovery of costs and attorney’s fees. Default under this Agreement does not modify or affect obligations owed to any vehicle lender.
- Voluntary Program Disclosure
Customer acknowledges that participation in the Drive Now Kickstart Program is voluntary and not required to purchase a vehicle. Customer elects to participate in the Program for the convenience of special purchase accommodations and Program Obligation arrangements.
- Independent Contract
This Agreement stands alone and does not modify or replace any terms in the Retail Installment Sale Contract.
- Customer Acknowledgment
Customer acknowledges that they requested participation in the Drive Now Kickstart Program, received the Boise’s Best Gift Pack, owe the Kickstart Enrollment Fee and Program Obligation, and understand that failure to pay may result in collection action.
KEY CUSTOMER ACKNOWLEDGMENT
By initialing below, Customer acknowledges and agrees to all of the following:
: Participation in the Drive Now Kickstart Program is voluntary and not required to purchase a vehicle.
: Program Obligations are owed directly to Boise’s Best Auto Sales and are separate from any lender financing.
: Program Obligations may be treated as a Deferred Down Payment only when permitted by lender rules.
: When lender rules require certification of down payment collection, Program Obligations are treated as a Dealer Receivable and are not represented to any lender as a down payment.
: The Kickstart Enrollment Fee is a dealership program fee and is not required by any lender.
: Customer has had the opportunity to ask questions and understands the terms of this Agreement.
- Electronic Signature
Customer agrees that signing this Agreement electronically using Boise’s Best Auto Sales signature system is legally binding and carries the same force as a handwritten signature.
